Please note, however, that We may need to retain certain information when we have a legal obligation or lawful basis to do so.

California Privacy Rights and Choices

This section explains rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA), where that law applies to our processing of Your Personal Data. California residents include individuals acting as business contacts, not only individuals buying services for personal use.

Where we process Personal Data on behalf of a business customer under its instructions, that customer is responsible for responding to requests about that data. You may contact the customer directly, or contact us so we can help route Your request.

Your Rights

Subject to applicable exceptions, You may request access to the specific pieces of Personal Data we hold about You and information about the categories collected, sources, purposes, categories disclosed or sold/shared, and categories of recipients. You may also request deletion of Personal Data and correction of inaccurate Personal Data.

You may opt out of the sale of Personal Data or sharing for cross-context behavioral advertising. Where applicable, You may also limit uses and disclosures of sensitive personal information beyond the purposes permitted by the CCPA. We will not discriminate or retaliate against You for exercising Your privacy rights.

Submitting a Request and Verifying Your Identity

Email support@athenahq.ai to request access, correction or deletion, to submit an account-wide sale/sharing opt-out, or to exercise an applicable sensitive-information right. Tell us which right You wish to exercise and provide enough information to locate the relevant records, such as the email address used with AthenaHQ. You do not need to create an account to submit a request.

For access, correction and deletion requests, we may verify Your identity by matching information You provide with information we already hold, or by asking You to authenticate through Your existing account. The verification required depends on the request and the sensitivity of the information. Please do not send passwords or government identification unless specifically requested through an appropriate secure method. If we cannot verify a request, we will explain why we cannot complete it.

Sale/sharing opt-outs and requests to limit eligible sensitive-information uses do not require the identity verification used for access or deletion. We may ask only for information needed to identify the information to which the request applies.

For requests covered by the CCPA, we will acknowledge access, correction and deletion requests within 10 business days and respond within 45 calendar days. If an additional period of up to 45 calendar days is permitted and needed, we will explain the reason within the initial period. We will process sale/sharing opt-outs and applicable requests to limit as soon as feasible and within 15 business days. If we cannot fulfill all or part of a request, we will explain the applicable reason or exception.

Email a privacy request

Authorized Agents

You may authorize an agent to submit a request using the same contact method. For access, correction or deletion requests, we may ask for proof of signed permission and may ask You to verify Your identity directly with us or confirm that You authorized the request, as permitted by law. Different requirements may apply to an agent acting under a valid power of attorney. For sale/sharing opt-outs or requests to limit, we may ask for evidence of the agent's authorization without requiring verification of Your identity.

Website Advertising and Sale/Sharing Opt-Outs

Our website uses optional marketing technologies to disclose online identifiers, browsing activity and conversion information to advertising and marketing partners. Conversion information can include contact identifiers supplied when You book a demo. These technologies support advertising and campaign measurement. Such disclosures may constitute a sale or sharing under California law even when no money is exchanged.

Use the Do Not Sell or Share My Personal Information link in the website footer. Turn off Marketing and save Your preferences, or choose Opt out of all optional tracking to disable both marketing and measurement. This choice applies to the optional technologies on this website in the browser where You make it. Necessary functions remain available.

We also recognize the Global Privacy Control (GPC) browser signal as an opt-out on this website. When detected, it overrides previously accepted optional tracking, disables marketing and measurement, and saves the opt-out in browser storage. The footer displays that the signal has been honored. Turning off GPC later does not by itself restore an earlier acceptance. While GPC remains enabled, optional tracking stays disabled.

Browser choices are stored locally and are not automatically synchronized to an AthenaHQ account, another browser or another device. Clearing browser storage removes the saved choice; an enabled GPC signal will apply again on the next visit. For an opt-out covering information associated with Your account or other interactions with us, email support@athenahq.ai. We use information supplied for an opt-out request only to process that request.

U.S. Privacy Requests and Appeals

We make the request and appeal process below available to U.S. residents, including Connecticut and Rhode Island residents. You do not need to determine which state privacy law applies before contacting us. Rights remain subject to applicable exceptions, including information we must retain for legal obligations or security.

You may ask us to confirm whether we process Your Personal Data; access it, including inferences about You; correct inaccuracies; delete it; or provide a portable copy. You may also request the identities of third parties to which we have sold Your Personal Data. If we do not maintain a person-specific list, we will provide the list of third parties to which we have sold Personal Data.

You may opt out of sales of Your Personal Data, targeted advertising, and profiling used to make decisions with legal or similarly significant effects, where we engage in such processing. You may ask about profiling involving Your Personal Data and request an explanation and review of such a decision. We will not discriminate against You for exercising privacy rights.

How to Submit a Request

Email support@athenahq.ai with Your request and enough information to locate the relevant records, such as the email address used with AthenaHQ. No new account is required. The identity-verification and authorized-agent procedures in the California section above also apply to this request process; sale and targeted-advertising opt-outs do not require identity verification.

We will respond without undue delay and within 45 calendar days. If an extension is permitted and reasonably necessary, we may take up to 45 additional calendar days and will explain the reason within the initial period. If we decline a request, we will explain why and how to appeal. Requests are free of charge, subject to legally permitted exceptions for excessive or manifestly unfounded requests.

For this website, use the Do Not Sell or Share My Personal Information link in the footer and turn off Marketing, or choose Opt out of all optional tracking. We honor Global Privacy Control for visitors in all regions. Browser choices do not automatically apply to other devices or account records; email us for requests covering those records.

Appealing a Decision

If we decline to act on Your privacy request, reply to our response or email support@athenahq.ai with the subject Privacy appeal. Include the original request or its reference and explain why You want us to reconsider. We will review the decision and send a written response explaining the outcome within 60 calendar days, or sooner where required by law.

If we deny Your appeal, our response will also explain how to contact Your state attorney general to submit a complaint. Connecticut residents may use the Connecticut Attorney General complaint page linked below.

Website Advertising and Analytics Recipients

Nuvotech Inc determines how Personal Data collected through this website is used and acts as its controller. Our advertising and marketing tools disclose online identifiers, IP addresses, device and browser information, browsing activity and conversion information to the providers identified below. Google Ads conversion information can also include an email address supplied when You book a demo. These disclosures support campaign measurement, audience insights and targeted advertising; they can qualify as sales under state privacy laws even when we do not receive money for the data.

Our website advertising and marketing recipients are Google (Google Ads, Google Analytics and Google Tag Manager), LinkedIn (Insight Tag), G2.com, Inc. (visitor and referral measurement), HubSpot, Inc. (website and marketing measurement), OpenAI (advertising conversion tools), and Microsoft (Clarity). Some of these providers use the information for their own advertising and service-improvement purposes. The tools that receive information depend on the page, interaction and Your privacy choices.

Microsoft Clarity collects website usage and interaction information for session measurement and can use it for Microsoft Advertising. We enable Clarity only when both Measurement and Marketing are enabled. PostHog and Vercel also receive usage and performance information for website analytics when Measurement is enabled.

Turn off Marketing in the website privacy choices to stop the advertising tools listed above, including Clarity. Turning off Measurement also stops Clarity, PostHog and Vercel analytics. Global Privacy Control or Opt out of all optional tracking disables both categories. The California section above explains how choices are stored and how to request an account-wide opt-out.

Personal Data and AI Model Training

We do not collect, use or sell Your Personal Data for the purpose of training large language models. We use AI services to process inputs and generate responses when providing requested features; this is separate from using those inputs to train a model. The AI Assistant Connectors section below explains transfers to AI clients You choose to connect and their separate privacy terms.

Third-Party API Usage

We use various third-party APIs to provide our services, including Google Workspace APIs.

AthenaHQ explicitly affirms that Google Workspace APIs are not used to develop, improve, or train generalized AI and/or ML models. Data obtained through Google Workspace APIs is only used to provide the specific functionality requested by users and in accordance with Google API Services User Data Policy.

You can learn more about Google's practices by visiting https://www.google.com/policies/privacy/partners/.

Use of YouTube API Services

AthenaHQ may use YouTube API Services to retrieve publicly available information such as video metadata, titles, descriptions, and publicly available comments, solely for internal analytical processing as part of our broader search intelligence platform. Data obtained through YouTube API Services is not sold, redistributed, or exposed as raw exports to end users.

Users of AthenaHQ acknowledge that by using features that rely on YouTube API Services, they are also bound by the following:

AI Assistant Connectors (Model Context Protocol)

AthenaHQ offers a remote Model Context Protocol (MCP) server that lets You connect Your AthenaHQ account to third-party AI assistants and clients (for example, Claude and ChatGPT). Connecting is optional and initiated by You.

  • Authorization: OAuth connections use OAuth 2.1. You explicitly authorize the AI client, and You can revoke that access at any time from Your AthenaHQ dashboard or the AI client's connector settings. For API-key connections, revoke access by deleting the key in AthenaHQ's API/MCP settings, or ask someone with permission to manage that key to do so. Disconnecting the AI client alone does not revoke the API key.
  • What the client can do: Once connected, the AI client can read Your AthenaHQ analytics and content, including AI-search visibility metrics, tracked prompts, competitors, cited sources, and AI responses. Where its credentials and permissions allow, it can also create, edit, or delete data, such as managing prompts or editing and deleting content. Access is limited to the organization and resources authorized for the connection.
  • How data flows: When You use an AthenaHQ tool in the AI client, the client sends the tool's inputs to our MCP server. We read data or carry out the requested action within the connection's permissions and return data or action results to that client. These may include Your prompts, content, and analytics. The AI client's handling of that data is governed by that client's own privacy policy and terms.
  • What we do with it: We do not sell data accessed through the MCP server, and we do not use it to train generalized AI or ML models. We log connection and request metadata (such as timestamps and the tool invoked) for security, debugging, and usage analytics, consistent with this Privacy Policy.

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law enforcement

Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Other legal requirements

The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:

  • Comply with a legal obligation
  • Protect and defend the rights or property of the Company
  • Prevent or investigate possible wrongdoing in connection with the Service
  • Protect the personal safety of Users of the Service or the public
  • Protect against legal liability

Security of Your Personal Data

The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security.

Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.

If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent, We may require Your parent's consent before We collect and use that information.

Changes to this Privacy Policy

We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page.

We will let You know via email and/or a prominent notice on Our Service, prior to the change becoming effective and update the "Last updated" date at the top of this Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
